On 7 August 2023, the Hungarian government notified a draft to the European Commission's TRIS system. The draft adds cannabidiol (CBD) to the banned additives in Annex 4 and sets out requirements for nicotine-free refill containers.

Part of the draft content
Nicotine-free refill containers meeting the following conditions may be placed on the market:
(1) The liquid must not contain nicotine;
(2) Nicotine-free liquids must not contain flavouring substances;
(3) Nicotine-free liquids must not contain the following substances:
additives listed in Annex 4;
vitamins or other additives beneficial to health;
caffeine, taurine or other additives and compounds with an energising or stimulating effect;
additives that colour the emissions;
additives that facilitate inhalation;
additives with CMR properties.
(4) Impurities in nicotine-free liquids must not exceed 0.1%;
(5) Nicotine-free liquids may contain only ingredients that are not dangerous to human health (whether heated or not);
(6) They must be fitted with a child lock and a device to prevent breakage and leakage, and the refill mechanism must ensure no leakage;
(7) Nicotine-free e-liquid refill containers must carry the warning "Ez a termek nikotinmentes utantolto flakon. Hasznalata gyermekek szamara tilos" (this product is a nicotine-free refill, use by children is prohibited) on the two largest surfaces of the packaging, covering at least 30% of the area.
In addition, on 11 April this year the Hungarian government also notified the European Commission's TRIS of a draft regulating nicotine-free vaping products. It requires notification to the Ministry of Health six months before nicotine-free products are placed on the market, and requires the government to lay down rules on packaging and health warnings for nicotine-free products. It also broadens the authorisation requirements for marketing tobacco products, bans advertising and distance selling, and designates smoking areas for electronic devices simulating smoking, nicotine-free products and nicotine-containing products. That act took effect on 1 November 2023.
