Vietnam MIC Revises Certification Requirements

Key words of this article:

The Vietnamese Ministry of Information and Communications (MIC) has made some significant changes to certification requirements and schemes.

Vietnam MIC revises certification requirements

Summary of the changes:

(1) Regardless of whether the certificate holder is the manufacturer or a local company, certificates must list full details of the manufacturer and the factory (OEM). If there are multiple factories, each factory should have its own type approval certificate, and the number of samples should be prepared according to the number of factories.

(2) Regardless of whether the certificate holder is the manufacturer or a local company, the certificate will show the country of origin of the factory. Previously, the country of origin was not mandatory if the certificate holder was an overseas manufacturer.

(3) Certificate holder:

★ Overseas manufacturer as certificate holder:

(1) An overseas manufacturer may only obtain certification if it has a representative office in Vietnam, and the representative office needs to confirm the factory (OEM) information.

(2) If one condition cannot be met, the certificate holder may be the importer.

★ Importer as certificate holder, in which case there are two conditions:

(1) The manufacturer and the OEM/ODM belong to the same organisation (with evidence): a three-year type approval can be obtained.

(2) The manufacturer and the OEM/ODM do not belong to the same organisation (with evidence): a three-year type approval can still be obtained, but the factory's ISO 9001 certificate must be provided and the OEM/ODM production must be assessed by video.

(4) A representative office may directly use the test report held in the manufacturer's name.

An importer may only use the test report in the manufacturer's name after obtaining an authorisation letter issued by the representative office or a consular-legalised authorisation letter.

(5) For test reports issued by MRA laboratories, VNTA only accepts reports issued against QCVN standards, not those issued against ETSI EN standards. MRA testing laboratories need to verify the test report and send a confirmation email as evidence. Because there is no local testing capability for some technologies such as 5G NR, test reports from non-MRA testing laboratories will only be accepted once the MIC announces acceptance of the test results.

(6) When using a module report, the applicant in the system should obtain authorisation from the report holder.

a. If the report holder is the manufacturer: authorisation from the manufacturer's representative body or consular legalisation should be obtained.

b. If the report holder is the importer: the module test report must list the type, model and manufacturer of the host device (the host device information listed must be consistent with the product information in the type approval application).
