On 15 April 2025 a draft European Commission regulation amending Regulation (EU) 2023/1670 of 16 June 2023 was published, setting ecodesign requirements for smartphones, cordless phones and tablets.
Requirements
Annex II of Regulation (EU) 2023/1670 sets requirements for the supply and delivery of spare parts and for disassembly procedures. One error affecting all mobile phones and tablets concerns the maximum delivery time, and there is a further error in the section on replacing display assemblies. To ensure clarity and consistency, the draft amends the disassembly requirements and spare parts availability provisions in sections 1.1(3) and 1.1(5) of parts A to D of Annex II as follows:
- on the maximum delivery time for spare parts, the draft clarifies that the ten working day delivery requirement now applies to all remaining years, not only the final two;
- a display assembly is added as an exception to the replacement requirement (Annex II, parts A, B and D, section 1.1, point 5(b)), meaning that non-professional users are not expected to replace the display assembly.
If adopted, the amendment enters into force on the twentieth day after publication in the Official Journal and applies from 20 June 2025, in line with the application date of Regulation (EU) 2023/1670. Comments were due by 14 June 2025.
