On 27 February 2024, the Indonesian Directorate General of Posts and Informatics Resources and Equipment (SDPPI) held a socialisation meeting on administrative sanctions.
The authority is tightening enforcement of certification and labelling requirements for equipment importers and distributors through administrative sanctions, particularly fines and penalties.
The reason is that, under the new regulations in force since 2018 with new labelling requirements, too many manufacturers, importers and distributors have failed to attach labels to their devices, user manuals and packaging. SDPPI conducted market surveillance and found the problem to be considerable.
Therefore, the SDPPI monitoring centre will now monitor all devices and investigate device certificates, labels and compliance, and will impose new administrative penalties where any non-compliance is found.

The three categories of non-compliance that will attract administrative penalties are as follows:
IPFR (radio frequency band licence)
1. Using SFR without obtaining an operating licence and/or official Indonesian approval;
2. IPFR holders using telecommunications equipment that has not yet been certified;
3. IPFR holders failing to fulfil the obligations required in the documents;
4. IPFR holders using radio channel names that do not meet their requirements;
5. IPFR holders entering into SFR cooperation without approval;
6. IPFR holders carrying out cooperation that does not conform to the objectives and/or principles stipulated in the statutory regulations.
ISR (radio station licence)
1. Using SFR without obtaining an operating licence and/or official Indonesian approval;
2. ISR holders using radio frequencies that are not in accordance with their intended purpose and/or do not conform to the technical parameters specified in the ISR;
3. Space ISR holders with earth stations failing to carry out the annual periodic registration.
APT (telecommunications equipment)
1. Manufacturing, assembling and/or importing telecommunications equipment for trade or use within the territory of the Republic of Indonesia without a telecommunications equipment certificate;
2. Manufacturing, assembling and/or importing telecommunications equipment for trade or use within the territory of the Republic of Indonesia that does not conform to the provisions of the telecommunications equipment certificate;
3. Trading in telecommunications equipment and/or communication equipment that has not obtained a telecommunications equipment certificate;
4. Trading in telecommunications equipment and/or communication equipment that has obtained a telecommunications equipment certificate but does not meet the technical standards;
5. Using telecommunications equipment that has not obtained a telecommunications equipment and/or communication equipment certificate;
6. Using telecommunications equipment that has obtained a telecommunications or communication equipment certificate but does not meet the technical standards.
If a holder violates the above provisions, the Indonesian authorities will impose administrative penalties by issuing a letter and require the holder to settle the fine within three months.
If the payer fails to pay the full fine within three months from the date of issuance of the third administrative penalty notice, the head of the PNBP management agency or its official will issue a PNBP billing opinion to the agency authorised to manage state receivables, and the matter will be handled in accordance with the statutory provisions in the field of state receivables.
If the payer fails to fulfil its obligations regarding the administrative fine bill, the authorities have the right to suspend its business licence in Indonesia in accordance with the law.
