Key words of this article:

UK withdraws exemptions for toxic chemicals

The new measures amend the scope of the 2012 Regulations on the Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment (the RoHS Regulations) in England, Wales and Scotland. Regulation 2(2) replaces old entries 1 to 9 in Schedule A2 with new entries 1 to 9.4. The revised entries exempt or repeal the restrictions in regulation 3(1) of the RoHS Regulations on placing on the market electrical and electronic equipment containing certain hazardous substances. Many of the exemptions concern mercury in various lighting equipment. Under regulation 10(8) of the Hazardous Substances and Packaging (Legislative Functions and Amendments) (EU Exit) Regulations 2020 (S.I. 2020/1647), decisions taken by the Secretary of State on exemptions have the same effect as the corresponding decisions under European Union law.

The duration of the exemptions in the regulations varies: some are renewed and others are repealed. The specific conditions of some exemptions have also been amended, in certain cases to set permitted mercury content or to broaden the categories of electrical and electronic equipment covered.
