From 16 October 2023, Amazon has formally implemented the Spanish extended producer responsibility (EPR) regulations, including the Spanish packaging law, the Spanish battery law and Spanish WEEE.
Sellers subject to the regulations are required to submit a valid Spanish EPR packaging registration number on the Amazon platform by 31 December 2023. If a seller does not submit a valid packaging registration number to Amazon before 31 December 2023, Amazon's "pay on your behalf" service will be activated automatically.
Under the terms and conditions set out in the policy on extended producer responsibility (EPR) requirements for third-party sellers in Spain, through this service Amazon will, for 2023 and thereafter and in respect of the seller's sales on the Amazon store, declare and pay environmental contributions to the relevant producer responsibility organisation on the seller's behalf, deduct the corresponding amount from the seller's account and charge an additional service fee.

Products requiring packaging law registration
From a compliance perspective, any seller of electronic products, packaged products, batteries and accumulators on the Spanish market must register and declare.
Main product categories covered by Spanish EPR
Single-use plastics, such as plastic boxes, plastic bottles and plastic wrapping;
- Electrical and electronic equipment (EEE), such as luminaires;
- Batteries and accumulators, such as rechargeable batteries and industrial batteries;
- Tyres, such as car tyres, but excluding bicycle tyres;
- Industrial oils, such as lubricating oils.
NTEK reminder
If Spanish EPR registration is not carried out as required, the seller's non-compliant products will be unable to clear customs. Depending on the degree of non-compliance, cross-border platforms such as Amazon will also block the products and restrict sales, and the seller may be fined up to EUR 1.75 million by the supervisory authorities.
Full implementation of EPR compliance across Europe is an inevitable trend. Based on this environmental policy, sellers should complete registration in the relevant categories such as packaging law, battery law and WEEE in advance according to the requirements of their own markets.
