In February 2026 the new Toy Safety Regulation (TSR) (EU) 2025/2509 was published in the Official Journal of the European Union. The regulation provides a 54-month transition period to give manufacturers and other economic operators sufficient time to adapt, and applies in full from 1 August 2030. The core changes are as follows.

Introduction of the digital product passport

The traditional EU declaration of conformity will be replaced by a digital product passport, accessible to the public through a data carrier such as a QR code attached to the toy. This significantly improves traceability and makes compliance checks easier for authorities and online marketplaces.

Tighter control of hazardous chemicals

The new regulation further implements the EU Chemicals Strategy for Sustainability and adds a number of prohibitions and restrictions, including:

- an explicit ban on the intentional use of per- and polyfluoroalkyl substances (PFAS) in toys;

- restrictions on bisphenols and other endocrine disruptors;

- limits on allergenic fragrances and certain preservatives.

New digital safety and mental health requirements

Toy safety is no longer limited to physical risks. For smart toys and toys with digital functions, the safety assessment must also cover mental health risks and meet strict cybersecurity standards in line with legislation such as the Cyber Resilience Act.

The new Toy Safety Regulation is also closely aligned with horizontal single market rules including the General Product Safety Regulation (EU) 2023/988, the Market Surveillance Regulation (EU) 2019/1020 and the Ecodesign for Sustainable Products Regulation (EU) 2024/1781.
