The Council of the Eurasian Economic Commission (EEC) has approved Decision No. 36, "On amendments to the Customs Union technical regulation on the safety of machinery and equipment (EAEU TR 010/2011)". The decision was published on 8 April 2026 and enters into force on 1 September 2026. However, the updated list of conformity assessment items under EAEU TR 010/2011 applies from 1 April 2028.
What the regulation says
The main amendments are as follows:
· The scope of the regulation is broadened;
· Mandatory safety requirements are laid down for machinery and/or equipment and for related processes, including development, production, installation, adjustment, operation, storage, transport, sale and disposal, so that they can be implemented and enforced within the customs territory of the Eurasian Economic Union;
· It is made explicit that machinery and/or equipment must comply with all applicable EAEU technical regulations;
· The types of machinery and equipment that are not subject to EAEU TR 010/2011 are clarified, taking into account that separate technical regulations already exist for such equipment. Household appliances, audio-visual equipment or office equipment, for example, may present an electrical hazard only during operation; such equipment is therefore subject to EAEU TR 004/2011 rather than EAEU TR 010/2011;
· New definitions are added to reflect changes in the product lists and in the documents submitted under conformity assessment procedures;
· Provisions on safety during the design, manufacture, storage, transport, operation and disposal of machinery and equipment have been elaborated and supplemented. Manufacturers may now choose whether to supply operating documentation in paper or electronic form. Paper documentation is still mandatory, however, for:
· Household equipment;
· Self-propelled vehicles;
· Specialised trailers;
· Equipment used in hazardous or potentially hazardous locations;
· For up to 100 units of self-propelled machinery or specialised trailers, a single EAEU declaration may be applied for;
· A procedure has been established for structural modifications to certified equipment;
· The number of equipment categories subject to certification increases from 15 to 31;
· The number of equipment categories subject to a declaration of conformity also increases, covering 64 product categories;
· A new Annex 4 is added, entitled "Requirements for the technical description used to confirm compliance of self-propelled machinery and specialised trailers with technical requirements".
